You might have heard about a lemon law before. You perhaps not have, however are still asking yourself what lemon laws are. In the event that this sounds like you we can help you realize what a lemon law is. Keep on reading to find out.

A lemon law are laws that are made to assist those who are buying a car. You may have purchased a car that persons call these lemon cars. They are duds. They break down and have everything wrong with them. Every state has them as they are very treacherous.

What the Better Business Bureau has found, people who buy used cars can’t afford that much money for a used car. They can’t pay for the repairs that most of the cars require and many car companies have cars that are used and they need to get off their lots. They fail to mention these things leaving these people with a hefty bill.

Normally, they find that these things happened just a few months after they got the car from the car lot. The things that went wrong should have been made aware to the consumer. That is why the lemon law that each state has is there. It’s there to help make sure you get your monies worth.

Now, if this is seen eighteen months after the car is bought or before eighteen thousand miles, the person who sold the car or the manufacturer should correct this problem. If they try to repair the damage and nothing can be done, they are to then replace the car. They must attempt to repair it at least four times for this to work.

The Better Business Bureau has been looking into this and firmly supports the customer when it comes to problems like these. They say they have witnessed too many accidents happen at the fault of a lemon car in which the lemon law was put into place.

As you now know what a lemon law is you might want to look at what laws exist in your state. If you don’t you mind be getting something that you don’t need to have and you have rights that can help you win in court. Don’t waste any time if you buy used cars. Whilst you could be thinking about what you could be entitled to, there are many more things that these laws do. They can help save lives.

Naturally, there are so many different areas of law that it’s difficult to keep up. For instance due to the internet, we now have people who specialize in cyber law.

We all know people who claim to be legal experts but have no formal training. If such a person has told you that you should run up your credit cards before you file for bankruptcy because all your debt will be discharged anyway, please disregard their advice. If the Bankruptcy Court senses that you are acting in bad faith and taking advantage of the system then they will dismiss your claim. Therefore, to get the Bankruptcy Court to stay on your side and give you the benefit of the doubt, you need to make sure you have not used your credits cards within 90 days prior to filing for bankruptcy.

It is understandable that most people who are filing for bankruptcy are doing so because they have little or no money to pay their debts. It is, however, a great idea to make some payments at least to some of your creditors with any disposable income you may have. It will help your cause with the Bankruptcy Court when they perceive that you are willing and would make payments to all your creditors if you had the means.

Bankruptcy petitions require mounds of information and financial data. Thus you can reduce your stress and help your attorney file your claim quickly by doing some homework. You will want to document or gather the following: (1) Mortgage(s) – Determine what your current appraisal value is as well as your pay-off amount, determine the mortgagors information, and determine what your monthly payments are and how many payments you are behind, if applicable; (2) Vehicle(s) – Ascertain the market value of all your vehicles, and if financed or leased, collect the lenders information and the pay-off amount; (3) Personal Property – make a list and place a value on your collective furniture and furnishings, collective clothing and apparel, collective jewelry, cash on hand, balance in checking and savings accounts, and any pensions plans; (4) List of Unsecured Creditors – Collect the addresses of all your unsecured creditors (i.e., credit cards, medical bills, personal loans, cash advances) and how much you owe; (5) Pay Stubs – Obtain pay stubs or proof of income for the 3 months prior to filing.

Make sure you have filed all your taxes with the Internal Revenue Service. The Bankruptcy Court will require that you be current on your taxes and usually, as is the case in Los Angeles courts, will require you to furnish your returns from the past two years. In addition, it is a tremendous help for your attorney to have your tax returns when drafting your petition to ensure all of your numbers are consistent. Do not worry if you do not have a copy of your tax returns because you can get a copy mailed to you from the IRS in just a couple weeks.

A complete accounting of all your expenditures can be extremely helpful in allowing the Bankruptcy Court to get a better sense of your financial pressure. Using your bank statements, your credit card statements, and your memory make a list of all of your regular monthly expenditures. Remember to include expenditures on items such as food, clothing, laundry, medications, taxes, alimony, school expenses, and personal care items.

When you are dealing with complex matters that can affect you for years to come it is a great idea to retain a specialist. Since you are reading this article it is likely that you are not bankruptcy savvy. Therefore, hire a qualified bankruptcy attorney to help you file and save yourself the stress of drafting a petition and the stress of having your petition dismissed for failing to provide correct information.

If you are contemplating a fresh start, think about filing for Bankruptcy. The Law Offices of Alon Darvish helps individuals file for bankruptcy.

The Governator has put his signature on a bunch of bills recently, including a new bill that requires ammo suppliers to store info from buyers. Ammunition sellers must track thumbprints, signatures, and driver’s license information.

In addition to the recording requirements, the bill also does away with all mail-order and sales made over the internet. All sales under the new bill must be performed in the presence of the seller.

The governor’s signature reverses his earlier position.

“Although I have previously vetoed legislation similar to this measure, local governments have demonstrated that requiring ammunition vendors to keep records on ammunition sales improves public safety,” Schwarzenegger said in a statement.

The head of Gun Owners of California said the law, which takes effect in 2011, will treat gun owners “like registered sex offenders,” the Los Angeles Times writes.

“We think it was a devastating mistake,” said Sam Paredes, executive director of the group, which represents 30,000 gun owners. In a separate statement, the group elaborates.

Despite signing this bill, the governor has also vetoed bills that would require additional signatures when buying a gun. Additionally, he vetoed a bill that would have put limits on the locations for gun shows.

Here are some other measures Schwarzenegger signed into law:

Out of state, pre-banned same-sex marriages will be recognized in California.

Prior to getting cosmetic surgery, patients will now have to have a physical examination. This bill, known informally as the Donda West Bill, follows the death of Kanye West’s mother from complications surrounding her cosmetic surgery procedure.

Photographers are now subject to penalties of up to fifty-thousand dollars for taking or dissemination of photos of the rich and famous during personal activities.

People running for office may not pay spouses for working on the candidates campaign.

May 22 was proclaimed Harvey Milk Day, recognizing the birthday of the slain gay rights activist and San Francisco city supervisor.

Finally, the governor is encouraging law-makers to revamp the state’s tax code which he considers completely outdated and not able to keep up with our information based society.

News, resources, and information regarding criminal law in the state of California. When you are facing charges for a crime, talk with a sponsoring California criminal lawyer near you today. The most practical way to protect your rights is by sharing your circumstances with a California criminal lawyer.

You might be surprised to hear it, but juveniles in the California juvenile justice system has decreased by almost seven thousand youths. Both youth (and adult) fire crews have helped save the state from around $80 million in the fight against wildfires. Also, the recidivism rate for adult inmates in California is only around 60%.

The California Dept. of Corrections has published “Corrections-Moving Forward”. This new publication reflects these facts and much more related to the climate of corrections in the state of California.

This publication includes a statistical update on everything from inmate population trends to return-to-custody statistics; from the impact of the three strikes inmates to a look at CDCR’s entire budget and a summary of the department’s 2008-09 accomplishments.

“Transparency in government begins with making information available to as many people as possible,” said CDCR Secretary Matthew Cate. “Through the Internet, our collection of data bases and Office of Research, we have worked hard to keep statistics on offender population and programs current and accessible.

Corrections – Moving Forward collects key facts from our expansive correctional system into one comprehensive report. As we face the challenges ahead, using current data to reflect on our population demographics will be crucial. We hope you find this new resource helpful in learning more about our agency.”

This publication has been designed to provide a general overview of significant challenges of California’s biggest governmental unit. Information is divided by gender, and age in some cases, so that trends facing specific populations can be explored. Information was provided by the Office of Research, CDCR Budget Office, the Division of Juvenile Justice Research branch, Division of Adult Institutions, and Division of Adult Programs.

This report was produced and printed entirely by CDCR staff to minimize cost while providing much needed information for legislative members, department staff, journalists and others interested in an accurate statistical picture of CDCR’s issues and challenges.

Presently the average American is over 100% in debt. That means that over 100% of their earnings should go to pay off their debt. With the economy in free fall and unemployment on the rise, over 5 million homeowners are facing an unfortunate reality of a lost job and tough times ahead. If you’re one of these American’s, you have already looked to the future and realized how far you can stretch what limited cash assets you have that have not disappeared into ether. Some say we must go back to consider life’s essentials: Shelter, Electricity, and Food.

Unsecured Debt: This is your credit cards. Pick up the phone, call your Credit Card Company and say, “I am broke, am considering declaring bankruptcy and need to speak to a Supervisor”. After you do that, ask the supervisor if you can do one of the following: (1) Make a one-time payment to satisfy the debt; (2) Request a reduction in payment, making sure that the reduction includes a reduction in your monthly interest payments. Have your attorney contact the Company if they say “No” to either (1) or Don’t be shy!! Don’t be embarrassed!! Disengage yourself and act as if you’re calling for your teenager and you just found out she bought $6,000 purse online and you want to send it back. By disengaging yourself your emotions are restrained, and you can be more objective to getting the best deal.

Bankruptcy: After you have completed re-negotiating your unsecured debt (credit cards), and secured debt (boats and cars); you can now re-evaluate your monthly financial situation. If it looks and feels a little bit better, then be positive. If after a few days, or even months, it seems to have had little to no impact, then it may be time to declare bankruptcy. Bankruptcy is no longer the end of diplomatic relations with your creditors, but it does require that you seek an attorney if you want to maximize your effectiveness in what assets you are allowed to maintain and not sell. If you declare bankruptcy, but want to keep the car you are still paying for then you can keep it out of bankruptcy. As long as it is secured by another creditor, you do not have to declare bankruptcy on the item. Normally in bankruptcy, unless a car has a secured loan on it outside of bankruptcy, you are allowed to keep a car with a value of up to $5,000 to avoid a forced sale if you own the car free and clear. Consult an attorney for the best approach when declaring bankruptcy or debt reduction to fully understand your rights prior to declaration.

Foreclosure: After you have addressed your secured and unsecured creditors, it is time to address your mortgage. In Florida, we have the protection of the Homestead Exemption Statute. Without going into too much detail, what it essentially means is that unless you have a mechanics lien, or a judicial decree, nobody can take your home away but your mortgage company (unless eminent domain issues apply). Just as you did with your secured and unsecured debt, you want to call your mortgage company. First, you pick up the phone and say, “I lost my job, I have no money and I believe I am not going to be able to pay my mortgage shortly.” Your options are similar as before: (1) Lower my interest rates or monthly payments, (2) Restructure my loan agreement, or (3) Talk to my attorney because I can’t afford my house. After this phone call is made, you need to consult an attorney about the next step to take. You need to consult an attorney before you make one more house payment. Do not worry because you are not going to get kicked out of your house tomorrow.

Fortnuately, new law is pending in Congress that will allow you to restructure with your bank without consideration. Something previously only allowed between merchants in contract law. We have all seen claims that can be postponed indefinitely. The fact is nobody really knows how long it can be postponed, as the courts begin to be clogged with foreclosures; yet, if you have to pay a power bill or your mortgage at this point – pay your power bill. The electrical company can cut you off, there is no laws that say they have to put you back on. The power company is absolute. You consumed the power, so consider your wallet wisely if you know your going to go under with your mortgage conserve your assets to take care of the same things our grandparents would a roof over your head, electricity, and food. It is the ultimate fall back situation, but faced with the alternative many of us will have little choice but to recess until the billion dollar budget plans put in place by the federal government, and a general credit stabilization takes place.

There is no need to be ashamed nor afraid; you are a survivor and this is part of surviving. Material things can be replaced. See your icebergs before they arrive, and start planning ahead. Keep a three (3) month plan in place, if you get within the ninety (90) day period and do not see the light at the end of the tunnel, you must hunker down and take care of the primary things that support life – shelter, electricity, and food.

In 2005, the California Criminal Intel Bureau reported the following Executive Summary regarding crimes committed by gangs and terrorists. This report is compiled in order to predict and stop these types of illegal criminal enterprises. Here are some of the trending behaviors the report found:

Many communities have been experiencing a reduction in gang activity as a result of gang injunctions. These efforts have reduced various gang-related activities and made some California communities safer from the dangers of gang violence.

While violent activity between gangs has been part of their history, in 2005 there was a marked redirection of violence toward law enforcement. Tragically, this re-focusing resulted in the deaths of more than 10 California law enforcement officers.

A governmental anti-gang initiative known as Community Shield, has been active in targeting MS-13 members (which is a Sureno gang). Several MS-13 members have been arrested relating to various crimes both violent and non-violent. Some of these include: narcotics offenses, grand theft auto, and various violations relating to paroled individuals.

Authorities note that many Asian gang members suspected of serious crimes flee to other states to elude capture.

The raketeer influenced corrupt orgs. Act, informally referred to as RICO, has led to many convictions for criminal conspiracies. RICO has been especially successful in getting convictions of outlaw motorcycle gangs. Convictions for murders, drug dealing, and other criminal enterprises have been obtain through continued use of RICO.

California has not suffered an attack by al-Qaeda. Authorities successfully prevented plots in 2000 and 2002 aimed at Los Angeles. It is believed that law enforcement initiatives specifically targeting this group have been largely successful in preventing their activities.

The United States prison system is the latest arena to experience an increase in terrorist organization. Recent investigations into these prison-system groups has heightened law enforcement’s awareness of these activities. These groups continue to grow and get more attention from U.S. law enforcement agencies.

by Gus Kalakis

Great article by Michael Hiltzik on LA Times today about tort reforms role as health cares circus sideshow. As Hiltzik puts it:

“Insurance companies love it because the less money they pay out to plaintiffs, the more they get to keep. Republicans love it because trial lawyers give three-quarters of their political donations to Democrats. And Democrats pay it lip service because theyre afraid to look like lawyer lovers.

Scapegoating medical liability as the reason for high health care costs is certainly nothing new. It just so happens that it is a convenient argument to make during debates on health care. “Frivolous lawsuits are causing this problem,” they shout. Are you surprised that the only people making these arguments are the ones who would benefit from not medical responsibility?

That facts according to Hiltzik are:

Liability for medical mistakes is estimated to contribute to no more than three percent of all U.S. health care spending. That means out of the over one-trillion dollars of annual health care costs, approx. fifty-billion dollars is comprised of malpractice litigation. In other words, even if we eliminated medical liability altogether, we would be in the exact same situation with health care.

The myth of medical liability being the main cause of health care costs has to end. We need to start focusing on the real problems and inefficiencies of the current system and stop chasing ghosts. Even if we got rid of medical liability in total, we would still be facing the same problems. Therefore, let’s shift the discussion to the real problems and stop filing in with the insurance lobby.

In fact, in places where tort reform has taken firm root, we have not seen a dramatic decrease in health care costs. Do you know what we have seen in those areas? Greater profitability for insurance companies. Even worse, people with legitimate personal injury and medical malpractice claims go without compensation.

The UK Building Regulations are used to set out the required standards around the construction and design of buildings and differs to obtaining planning permission for your work. The regulations apply to the majority of new buildings and alterations of existing buildings in England and Wales, whether they are domestic, commercial or industrial buildings.

The current regulations are mainly found in The Building Regulations 2000 (although there have been a variety of updates since) and were introduced under the premise of the Building Act 1984. They clearly spell out the guidelines for which buildings should be constructed to.

The reason behind their introduction was mainly for health and safety purposes for the people that were then going to use the buildings that were erected. As well as this reasoning there were also introduced to conserve energy within those buildings.

These regulations are broken down into a number of sections such as toxic substances and within that section there is a detailed explanation of what is expected from the building work. While there are exceptions, when undertaking building work this work must be the requirements specified within each section.

The UK Government publishes guidance on ways for people to meet these requirements in what are known as approved documents. These are often updated when a new piece of statute amendment is passed and is comes into effect.

If you are undertaking building work such as that on a construction site then you need to be aware that you have the responsibility for ensuring that your works meets the requirements set out within the regulations.

It is essential that if you are having work done that you understand that while the builder must meet these regulations, you will be the one served with the enforcement notice to rectify the work. There is a list of the types of projects that are regarded as building work and these can be found within Regulation 3.

Keeping up to date the the UK building regulations is not easy. For the latest updates and current versions of the regulations simply click here: building regulations approved document

For most people finance and financial matters are something that they have no clue about. This lack of knowledge at times results in the particular individual in question to take steps which eventually land them in trouble and they need to explain or bear the consequences of the government regulatory authorities.

This is where professionals like Tax Lawyers come in. Tax lawyers are people who take care of financial related matters for their clients irrespective of whether they are individuals or large business houses. The expertise of a tax lawyer depends on the kind of educational qualifications and the relevant work experience that he has done.

They also keep track of regulatory or policy changes that happen with regards to financial acts or policies and also accordingly advise their clients i. E. The business’s and individuals of such changes.

Tax lawyers also advise and guide their clients in all financial related matters and take care of things like Income Tax, Excise, Property tax etc. The tax lawyers keep a track of their client’s financial activities and advise corrective or alternate course of actions wherever required.

The represent their clients case and also take decisions pertaining to financial matters on behalf of their clients. A tax lawyer is also required to apprise his clients of the possible financial problems or litigations that he might get into on taking a particular decision and would also suggest an alternate route of doing the thing correctly.

The virtues of a good tax lawyer are that they are good negotiators and have exceptional communication skills. Apart from that they need to be up to date in terms of their knowledge base and need to apprise their clients of all the developments or changes which take place in any policy or law.

This is very essential because then the client will also be able to plan his financial decisions in a much more comprehensive manner and will be able to avoid any trouble because of an uninformed decision. Be it an individual or a business, the tax lawyers role is more in sync with the role that mentors or guides play with their wards or in this case with their clients.

The best thing is that the more well known and well informed the tax lawyer is of the client, the less trouble he will get into as the tax advisor will be able to foresee a lot of things and be able to suggest possible corrective measures

When people need someone to represent them for a legal case, they turn to lawyers. Their work involves tangible use of abstract legal information and theories to unravel specific problems. The responsibilities of attorneys differ extensively across legal jurisdictions. Attorneys tend to back both non-legal and legal institutions. Educators of law may consider themselves as either system critics or reverent to authority

A few specialist practitioners keep close connections with other lines of work that they collaborate. As an example, legal representatives and physicians comprise the Medical-Legal Society membership and accountants and attorneys belong to foundations like the Canadian Tax Foundation. And much more common is the involvement of attorneys with their business clients due to annual retainers.

These attorneys are usually connected with ethnic groups, political parties, religious groups and special interest groups, which include credit unions, consumers’ organization and civil rights groups. They make up crucial links among different classes of social sectors, institutions and political outlooks. And in point of fact, their connections to such bodies is oftentimes recognized as estranged loyalty which may aid in explicating why attorneys are persistently perceived with hesitations by those people that they’re attached to.

Attorneys are extensively mixed up in politics. Significant amount of provincial premiers, legislators and federal cabinet ministers are attorneys. They are also deeply involved with political parties as policy advisers, campaign managers and strategists. Administrators who perform adjudicative functions are mostly lawyers.

The idea of politics is often linked to the job of lawyers. There are people who see attorneys as untrustworthy while there are also some who respect them. In almost all countries, specifically civil law countries, giving several legal tasks to various civil law notaries, scriveners and clerks has been a tradition. These countries don’t have attorneys in the American perception rather their legal practices consist of a huge number of various kinds of jurists.

More often than not, attorneys generally brief the court by depicting the cases through writing before arguing about it orally. They characteristically conduct wide research first and collect pertinent facts as they summarize, outline and set up such legal papers that they intend to discuss orally. Most lawyers work in law firms. Most law firms all over the globe are small businesses that vary deeply in size and consist of about one to 10 attorneys.

In some countries, almost any cases are being taken by attorneys. And in nations where such specialization or dedicated to a specific field of law is prevalent, attorneys are usually categorize based on their expertise and experiences as they stand for their clients and depend them on court. In the United States, anyone can have attorneys who are dedicated to specific cases and it is always advisable to pick lawyers based on their expertise.
